Notification to our clients and employees: We have received a handful of inquiries about the REFORM INITIATIVE that the executive power presented to the Congress, regarding the PROHIBITION OF SUBCONTRACTING / OUTSOURCING, and we want to inform you of the following: First and foremost, it is important to understand that the reform initiative in question is aimed at companies that SIMULATE hiring staff in order to AVOID employer responsibilities, such benefits and the payments of contributions derived from hiring staff. With this being said, all of our clients and employees know and are aware that HUMAN RESOURCES MEXICO, S. DE RL (HRM) FULLY complies with its EMPLOYER responsibilities before ITS EMPLOYEES, and before the corresponding social security institution , federal tax authorities, and federal immigration authorities. Second, HRM provides the required services ALWAYS AND EXCLUSIVELY TO COMPANIES LOCATED ABROAD, who DO NOT HAVE A CORPORATE NOR TAX ADDRESS IN MEXICO. Therefore, our services are NOT USED IN OUR COUNTRY, but comply with the needs of our clients abroad. Unfortunately, with poor writing, the INITIATIVE contemplates the PROHIBITION OF SUBCONTRACTING / OUTSOURCING, However, we consider that it would NOT affect us, since HRM provides specialized services to companies located abroad who require from us, the strict compliance with the labor and tax laws of Mexico. It is important for all to remember that the professionals hired by HRM are recognized as our employees, and that HRM is complying with all the corresponding benefits and obligations; that HRM is NOT an organization that AVOIDS OBLIGATIONS, and that we will continue working hard to provide everyone with the compliance of laws required for their jobs. HRM goes through a dictamen fiscal (Certified Tax Audit) every year, with outside auditors, certifying our monthly, bi-monthly, and annual tax payments to the government of Mexico. We are the only PEO (Professional Employer Organization) in Mexico that submits the certified tax audit to SAT (The tax authority) every year. The employees of Human Resources Mexico can vouch that we are a first class company who adheres to and respects all tax laws in Mexico and the rights of the employees under the Mexican Constitution and Federal Labor Law. We are in complete agreement that any employer in Mexico who does not pay the appropriate taxes and/or does not honor the rights of the employees, should be heavily fined or shut down completely.
