First and foremost, it is important to understand that the reform in question is aimed at companies that SIMULATE hiring staff in order to AVOID employer responsibilities, such benefits and the payments of contributions derived from hiring staff. With this being said, all of our clients and employees know and are aware that HUMAN RESOURCES MEXICO, S. DE RL (HRM) FULLY complies with its employer responsibilities before its employees, and before the corresponding social security institution , federal tax authorities, and federal immigration authorities.
Second, HRM provides the required services always and exclusively to companies located abroad, who DO NOT HAVE A CORPORATE NOR TAX ADDRESS IN MEXICO. Therefore, our services are NOT USED IN OUR COUNTRY, but comply with the needs of our clients abroad.
Unfortunately, in broad writing, the reform PROHIBITS (in general) SUBCONTRACTING / OUTSOURCING, However, we consider that it would NOT affect us, since HRM provides specialized services to companies located abroad who require from us, the strict compliance with the labor and tax laws of Mexico.
IMPORTANT NOTE: The law keeps the door open for companies with specialized subcontracting (Such as Human Resources Mexico.) There is a new registry being established for companies like ours. A company registering as a specialized subcontractor will need to provide the following:
WE COMPLY WITH 100% OF THE ABOVE. It appears that within the next several days, the registry will OPEN, and our lawyers and fiscal auditors have been instructed that Human Resources Mexico, S de RL will be the FIRST COMPANY REGISTERING IN MEXICO.
The Secretary of Labor in Mexico will verify that the registered company is 100% up to date with it's tax obligations, and that federal income tax and annual profit sharing is being paid. (This is why global PEO's will not be able to register in the new registry. Hence, will most likely have to terminate all of their employees and cease operations in Mexico. They do not pay federal income tax and annual profit sharing.)
It is important for all to remember that the professionals hired by HRM are recognized as our employees, and that HRM is complying with all the corresponding benefits and obligations; that HRM is NOT an organization that AVOIDS OBLIGATIONS, and that we will continue working hard to provide everyone with the compliance of laws required for their jobs.
HRM goes through a dictamen fiscal (Certified Tax Audit) every year, with outside auditors, certifying our monthly, bi-monthly, and annual tax payments to the government of Mexico. We are the only PEO (Professional Employer Organization) in Mexico that submits the certified tax audit to SAT (The tax authority) every year.
We have also sent official letters physically, and in digital form via email to 53 senators, congressmen, and government officials, bringing their attention to our company and our PERFECT TRACK RECORD of 12 years; our intention of being the first party to register in the new specialized subcontracting registry.
Therefore, we do not see an issue with our services. We plan to continue as we have for 12 years.
