The Most Trusted PEO in Mexico...July 27, 2021 Human Resources Mexico, S de RL (HRM) filed for constitutional protection with the federal court and was granted a suspension in our favor. The law as it is today DOES NOT APPLY TO US and NO ONE CAN ATTEMPT TO APPLY THIS LAW TO US. We are 100% operational and continue providing PEO services to foreign companies that do not have a legal presence in Mexico. A few comments about the outsourcing / subcontracting reform:
We are in agreement with the authorities in Mexico that the laws should be enforced so that employees receive their mandated federal benefits, their finiquitos when resigning, severance pay when terminated, and their PTU (Profit sharing every year.) We are also in agreement that all companies should be paying their federal and state taxes according to the laws in Mexico. It is not a level playing field when you have companies not following the laws. It is important to understand that the reform in question is aimed at companies that SIMULATE hiring staff in order to AVOID employer responsibilities, such benefits and the payments of contributions derived from hiring staff. With this being said, all of our clients and employees know and are aware that HUMAN RESOURCES MEXICO, S. DE RL (HRM) FULLY complies with its employer responsibilities before its employees, and before the corresponding social security institution , federal tax authorities, and federal immigration authorities. Second, HRM provides the required services always and exclusively to companies located abroad, who DO NOT HAVE A CORPORATE NOR TAX ADDRESS IN MEXICO. Therefore, our services are NOT USED IN OUR COUNTRY, but comply with the needs of our clients abroad. It is important for all to remember that the professionals hired by HRM are recognized as our employees, and that HRM is complying with all the corresponding benefits and obligations; that HRM is NOT an organization that AVOIDS OBLIGATIONS, and that we will continue working hard to provide everyone with the compliance of laws required for their jobs. HRM goes through a dictamen fiscal (Certified Tax Audit) every year, with outside auditors, certifying our monthly, bi-monthly, and annual tax payments to the government of Mexico. We are the only PEO (Professional Employer Organization) in Mexico that submits the certified tax audit to SAT (The tax authority) every year. In conclusion. We continue as we have for 12 years.
